– Can a minor get a tattoo?
– First, let’s define the concept of “minor.” The current civil legislation of the Russian Federation separates the legal capacity of minors aged 14 to 18 years and the legal capacity of minors, i.e. minors who have not yet reached the age of 14 years.

- What, in this case, is allowed by the first, but not allowed by the second?
– According to Art. 26 of the Civil Code of the Russian Federation, a minor aged 14 to 18 years has the right to independently, without the consent of parents, adoptive parents or trustees, dispose of their earnings, scholarships and other income, and make small household transactions. In relation to other transactions, a minor aged 14 to 18 years must obtain the consent of legal representatives (parents, guardians, adoptive parents). Young children aged 6 to 14 years also have the right to independently carry out small household transactions to dispose of funds provided by a legal representative or with his consent by a third party for certain purposes or for free disposal (Article 28 of the Civil Code of the Russian Federation).

– Is a tattoo included in the concept of “small household transaction”?
– The legislator does not give a clear answer as to what constitutes a small household transaction, leaving the right in each specific case to determine the appropriate criteria classifying a transaction as small and household. However, it can be assumed that this kind of transactions includes only insignificant amounts, not exceeding, for example, the monthly total income of a teenager, transactions and only those that satisfy his daily household needs: buying food, textbooks, clothes, payment for travel in transport and so on. Of course, it is impossible to classify the application of a tattoo, even with every desire and the probably low cost of this service, as a domestic transaction of minors.

– So a child can’t go to a tattoo parlor and say “do it!”?
- Of course, he can go, but I think the tattoo artist will never take on this.

– What can stop a tattoo artist?
– The current legislation of the Russian Federation does not regulate in any way the activities of a tattoo artist, does not define this type of activity as a certain profession, does not include tattooing activities in the list of licensed medical services (while tattooing is included in the list of cosmetic services, but by definition is not equated to tattooing in its classical sense). In this connection, it is quite difficult to clearly determine the requirements for the provision of this type of service, including obtaining the consent of the legal representatives of minors to apply a tattoo.

– Does the artist who undertakes to give a tattoo to a minor bear any responsibility?
– Getting a tattoo is a voluntary right; no one can force a person to wear it. This is reflected in the Geneva Convention relative to the Protection of Civilian Persons in Time of War of August 12, 1949. Such a prohibition is the implementation of the human right to personal integrity, which is also enshrined in the Constitution of the Russian Federation (Article 22). And only for forced tattooing can we talk about liability, in particular criminal liability, for causing harm to health. The current legislation of the Russian Federation does not contain a special crime or administrative offense providing for liability for applying a tattoo, including in relation to a minor. However, in order to avoid controversial situations and rather extensive and subjective criteria for transactions that minors can make without the consent of parents and other legal representatives (I note once again that the legislator does not clearly define what applies to small household transactions and does not limit the actions of a minor in aged from 14 to 18 years when managing their own money), I still recommend that representatives of salons providing this type of service clarify the age of their client, and also require the written consent of a legal representative to apply a tattoo if the client is a minor.

– Is it necessary for the client to have a passport?
- Necessarily. According to the salon procedure, you need to ask even grandmothers for a passport, since the document data is entered into the registration system.

– What awaits the artist if he takes on a tattoo for a minor?
– According to the law, the foreman faces administrative liability. A fine, for example. But in reality, he will simply receive a slap from the parents of the unfortunate child. I don't think the police will deal with this type of case, unfortunately...

– Are there any licenses for this work?
– Tattoo licenses, of course, exist, or rather, they do exist, and having one for a tattoo artist is a plus, but not the main one.

– Is this procedure regarded as cosmetic?
– The tattooing procedure refers to decorative modifications of the body. Tattoos have a common principle with tattooing, but the task of a tattoo is to permanently apply a design to the client’s body.
– The hygienic side of the issue. Are there any standards?
– The hygienic side: like in the operating room where I work. If your workplace does not resemble an operating room, this is a warning sign.

– What education should a tattoo artist have?
– There is no special education that a tattoo artist should have. Art and medical education are, of course, welcome, but these are all “related disciplines.” A tattoo artist is judged not by his education, but by his portfolio and reputation. Portfolio photos are what he can do, Reputation is how his tattoos heal later. It is advisable to know at least one person with a tattoo from a potential artist that has healed well, that is, the client likes the way it looks now.

– Do you bear any responsibility for the quality of the tattoo and the consequences after the procedure?
– The responsibility of the artist is determined by the contract that you sign before applying the tattoo, or stipulate. – Who draws up this contract and what must be included there? – The contract is drawn up by the owner of the establishment, usually it states that the client got the tattoo of sound mind and good memory, has no aesthetic complaints against the tattoo artist for the work done, since he assessed the portfolio and estimated at what level and in what style his tattoo will be done. But in case of unsuccessful healing, even due to the fault of the client, the tattoo artist undertakes to correct the tattoo.

– Are there any signs that you will not undertake to fill?
– Drawings on your body definitely change your destiny, but not in a mystical way, but because those around you, and as a consequence you yourself, perceive you differently, taking into account these very signs. I do not undertake to make racist and Nazi symbols. Never.

A tattoo is a way to express yourself, decorate or change your body. Many teenagers want to use violence to express themselves and express their protest. However, getting a tattoo as a teenager is not a good idea.

Some obstacles

A tattoo can be done without any problems from the age of eighteen; any adult can simply come to the salon and express such a desire. To get a tattoo at an earlier age, you will need not only the desire, but also the consent of your parents, recorded in writing, in addition to this, you will have to present an identification document.

Tattoo removal is a rather painful and expensive procedure, and it is not always effective.

This alone can dampen the desire to get a tattoo at the age of fourteen or fifteen, since it is quite difficult to persuade parents to make such a decision. But this is a bureaucratic problem. Technical problems are a serious argument against getting a tattoo at an early age.

Fourteen to fifteen years is a time of active growth and hormonal changes. At this time, it is still quite difficult to predict how a person’s figure and proportions will change. Therefore, even the most beautiful and detailed tattoo, as such natural changes occur, can “float” and lose its attractiveness. Correcting something like this may not be easy in the future, and such “covering up” of an unsuccessful tattoo will cost a considerable amount.

A tattoo is forever!

In addition, many teenagers have very radical tastes and views, as a result they most often order aggressive drawings of a fairly large area. Over time, a person’s views change, as do his ideas about his body and soul. So after twenty to twenty-five years, many want to get rid of the tattoo, which was the result of a rash decision, or change it again. This is especially true for drawings applied to open parts of the body - arms, stomach, legs. Such a regular reminder of a questionable decision can be very annoying, and besides, drawings can simply get boring, so it’s better to do them in places that can be hidden under clothing.

When looking for your image, it is better to experiment with temporary tattoos.

It is also necessary to take into account that tattoos on visible parts of the body can change the perception of people around them about their wearer. And if in the future you are going to build a career in any serious corporation or do business, tattoos can seriously hinder you in this.

Hormonal changes are another reason not to get a tattoo as a teenager. Some tattoo artists believe that during such a restructuring of the body, the ink may not adhere properly or even cause allergic reactions. It is better to wait until the end of adolescence and then apply a tattoo.

Before you decide to get a tattoo, you need to clearly understand: it will remain on your body for life. Of course, it is possible to remove it, but this is fraught with scars, burns, infections and other unpleasant consequences. In order not to regret later, it is better to refuse:
any tattoos in the form of the genitals or, even worse, on them;
a drawing that came to mind in an inadequate state (intoxication, during a period of special joy or sadness);
an image that has something in common with a school or institute, since after a while it will become insignificant and simply useless;
something especially popular right now (emblems of musical groups, TV shows, images of characters from films, books and comics).

Tattoos with the name of a lady of the heart or a beloved man are popular. But, according to tattoo parlor workers, owners of just such designs most often turn to the artist with a request to remove or redo the tattoo. Therefore, even if the relationship seems eternal, and the intentions are the most serious, it makes sense to think carefully about the advisability of such an act.

As for inscriptions in exotic and unfamiliar languages, everything is not so simple here either. Before applying any phrase to your body, you should not just find out, but thoroughly study its meaning. This is especially true for various symbols in ancient languages, as well as hieroglyphs, which often have double connotations.

How not to make a mistake in choosing

It is necessary to start choosing a tattoo, first of all, with the design and plot: will it be just a beautiful drawing, an inscription or some kind of symbol. You shouldn’t chase fashionable tattoos that are full of Internet pages. It is better to sketch a sketch yourself, based on your internal state, and contact the master with a request to improve the drawing.

Then you should forget about the tattoo for a while, this could be several months or even a year. If, after such a long period, the desire to apply this particular design to the body has not changed, then, perhaps, you can go to the salon.

When choosing a tattoo, you need to consider the location of application. This is an issue that requires special attention. It’s better to figure out in advance how the tattoo will look with different clothes, shapes, and styles. In addition, given the fact that the pattern will remain on the body for life, you need to remember that sooner or later the skin will age and sag. Will the chosen design look beautiful on a flabby and wrinkled body? Most likely no. Therefore, the best place for a tattoo is where the skin remains elastic for a long time.

Choosing a tattoo is a very personal, even intimate matter. It is better to apply a tattoo in adulthood, when a person has already sufficiently known himself, his strengths and weaknesses. What the law says

According to our legislation, the profession of a tattoo artist does not exist. Getting a tattoo is not a medical procedure. The work of tattoo artists is not regulated by laws, like, for example, the work of doctors.

Are your parents threatening to drag through the courts any artist who dares to give you a tattoo or piercing? It is unlikely that you will be able to punish the master for this, but there may be different situations. Imagine: to get a tattoo on your back, you had to take off your T-shirt during the session. If desired, this can be subsumed under the article “corruption of minors.”

Therefore, an adequate master will not undertake to give you a tattoo without your parents. A master who makes tattoos at home may agree, but this should be approached with caution. It’s easy to run into unsanitary conditions and all that.

Are you allowed to get tattoos and piercings under 18? We read the Civil Code, Article 26: “Minors aged 14 to 18 years have the right to independently, without the consent of parents, adoptive parents and guardians, make small household transactions and other transactions.” The law does not explain what “small household transactions” are. But if you look closely, a tattoo can hardly be called a small everyday transaction.

In short, until the age of 18 you will have to accept that your parents or guardians are responsible for you. After 18, you will receive all the rights and freedoms: you will be able to vote, get tattoos, get married, etc.

Three or four times I tattooed young people under 18. I worked in the same way as with another client. Masters are not psychologists or nannies. Either I approach all clients responsibly, or I approach them all irresponsibly. It doesn't matter to me what age a person is. I'm just doing my job. But I think it’s very important to tell teenagers about all aspects of life with a tattoo.

Who usually gets a tattoo or piercing?

Often the desire to get a tattoo or piercing occurs among teenagers who have problems with self-confidence, adaptation, or who have conflicts with their parents.

I had teenagers who consulted me about tattoos: they say, I want to get one, but I don’t want to tell my parents. Some started with one design or piercing, but did not stop there.

I'm not trying to dissuade you. I try to break down this decision into pros and cons: tell you what you can gain and what you can lose.

I also advise you to take a break, not to do it at the same moment as you want.

So what can you lose?

Firstly, you can change your mind later. Today they tattooed themselves with “Vasya, I love you” or some fashionable symbol, and tomorrow they stopped loving Vasya, and the fashion for the symbol has passed.

Secondly, others may not understand. You need to be prepared for this. We got a tattoo, you like it, and your friends say: “Pfft, some kind of hat.” Or parents may not accept it because they were raised in a completely different culture, where a tattoo was considered unacceptable, a sign of a criminal, a prostitute or a “dirty punk.” Or the parents have some friends. And so they go to their dacha, and they tell you: “Sorry, we can’t take you, they won’t appreciate your tattoo.”

And thirdly, life can change. Elementary: there are companies that have a strict dress code. If you have a tattoo, you may not get a good position there. Or you meet a girl’s parents, and they have a stereotype: if you have a tattoo, it means you have a criminal record, and their attitude towards you will deteriorate.

What can you get?

Increase your self-confidence. It is no coincidence that people started getting tattoos back in the Stone Ages. This art has deep roots.

Or you want a tattoo to join some group. For example, to fans of your favorite football club or an underground music scene. You do it and they accept you there.

Another tattoo or piercing is a way to control your life (or show that you can control it). My body - I want and I do.

Besides, a good tattoo can be simply beautiful. This is creativity.

What about the physical consequences?

They are. In teenagers, the body is not yet fully formed. We grow up to about 21 years old - and the tattoo stretches. How the drawing will behave and where it will lead in a couple of years is unclear. What if the beautiful cat ends up turning into a rat?

And don’t forget about hormonal changes. A teenager’s body is already in a stressful state all the time: hormonal storms, changes, and here something else unusual happens to the body. They inject dye into your skin, essentially a foreign object.
