Medical issues

Most often, parents are faced with the fact that they are refused due to the fact that their son or daughter does not have the necessary vaccinations or does not have a medical card.

Where to complain:

  • if doctors do not issue a medical card, we demand from them a written explanation of the reasons for this, then we make a copy of the document and attach it to a written complaint addressed to the head of the medical institution, and if necessary, to the prosecutor;
  • If the refusal comes from the head of the kindergarten due to the child’s lack of all vaccinations, we also demand a written explanation and write complaints to the departments of education, health, Rospotrebnadzor and the prosecutor’s office.

Of course, the complaint may not lead to positive results, and the child will remain without a place in the garden. But it's important to remember that The law gives everyone the right to refuse vaccination, and the child has the right to study. If the child does not have a residence permit

Many parents also do not know how to behave if their child is not included in the waiting list because he does not have a residence permit in his region of residence. This question is especially relevant for those who often move from place to place.

What to do if you don’t have registration in your region of residence:

  • Officially obtain temporary registration for parents at the address of residence and, on the basis of this document, request that the child be registered;
  • The Law “On Education” stipulates that an official rental agreement for an apartment, without registration in it, can serve as a basis for adding a child to the waiting list;
  • get one of the parents a job in a kindergarten, as this will automatically get a place for the child.

The availability of benefits can also make it easier to find a place for a child in a kindergarten in a temporary residence center. You can also directly contact the head of the kindergarten; perhaps the institution has free places and will accept the child without problems, or they will advise where else to go.

Petition: another way to solve the problem

Petitions can be sent either to the head of the department responsible for education in the region, or to any head of a preschool institution. Parents themselves and other persons can make such requests. For example, there may be a request to speed up the procedure for issuing a permit to the garden.

Court: the last resort

If neither petitions, nor personal appeals, nor complaints help, you can file a claim in court. To do this, we collect as many written responses as possible from institutions that deal with issues of registration, admission of children, and issuance of certificates.

For example, if the queue does not move for a long time, it is already time for the child to go to kindergarten, but the department claims that there are no places, we write a complaint asking to indicate the reasons why they do not provide a ticket to the institution, and we take it to the secretary of the head of the department. We write the complaint in two copies, keeping one: the secretary must put a stamp on this document that the complaint has been accepted, indicating the date of receipt. A response should be received within 30 calendar days. The reason for going to court may be the lack of accurate information when a place will appear.

In the statement of claim we indicate that the child has the right to preschool education, but the administration refuses to create a place for him. As practice shows, the court often rules in favor of the plaintiffs, and the administration will eventually be obliged to find a place in the kindergarten. It usually takes from two months to six months to resolve a court case. If the district court refuses to satisfy the claim, we appeal to the appellate court.

However, in some regions of Russia there is also judicial practice on this issue that is negative for parents. To win the case, in addition to a statement declaring the actions of the municipality illegal, it is advisable to submit to the court:

  • explanation of the claim;
  • a written copy of the speech at the trial;
  • copies of requests and responses to them;
  • copies of decisions of similar cases in other courts.

It’s even better if the appeal is collective. This will increase the chances of success. In the case of a collective appeal, one can also hope to attract interest in the case from the media.
